On motion of Mr Anderson, ot Clay, the report of the committee on Privi leges and Electious, unseatiug W. P. Mabson, the number from Edgecombe, was takenup. Tne weight ot the testi monv goes to show that the said Mabson was not a ci'.izan ot Edeecombc county 12 months prectding his e ection. The testimony was, on motion of Mr Ueaton, read. After reading the evidence Mabson took the floor and, in substance, said : I have onlv one or two remarks to make in reference to my claim to a seat on this floor. I have been a citizen of Edgecombe counry since 1869, as my swo'rn statement to the commiitee will show. When I left that county, I left lor temporary purposes, and when my engagement in other counties termina ted I returned to Tarboro and resumed my' employment there, I only ask justice at the hands of this body, and if it is deemed proper to return me to my constituents, I accept the situa- tl0Mr Badger then argued as to the con stitutional meaning of the word "resi dent." He thought that within tie meaning of the law Mabson had a residence in Edgecombe counry twelve months preceding his election, &c Mr. Norment thought the weight ot the evidence was in favor of the sitting member, and went on to analyze the testimony presented by the Committee on Privileges and Elections. thought the tact of Mabsotfg having registered, and voted in Beaufort county, while claiming to"Ie a cfT7zrn of Edgecombe, amounted to nothing more than a breach of the criminal law of the State. Mr Bartger then read from the deci sion of Judge Gaston in the case of Roberts .vs. Cannon, 3rd Dev. & Bat., 25G Mr Fletcher, followed in favor of the claims ot the incumbent. After a long debate on other amend ments, the matter under consideration was postponed lor the introduction, by Mr Goodwyc, of the following resolu tion : liesohed, That the Governor be in formed that, by a vote ot this House, W. P. Mabson has been declared not entitled to a seat in this body as a mem ber, and that a vacancy therefore exists in the representation from Edgecombe county. The resolution was adopted.
